Terms of Use

1. Acceptance

By using our websites and services you agree to these Terms. "Our websites and services" means homesbybailey.com, kevinbaileylisting.com and its seller toolkit, novahomevalues.net, kevinbaileyreviews.com, referkevin.com, kevinbailey.net, kevinbailey.co and tourkevinslisting.com, our phone and text line 571-496-9009, and the emails we send (together, the "Services"). If you do not agree, please do not use the Services. Your continued use after a change to these Terms is acceptance of the change.

2. About us

The Services are operated by Kevin Bailey Team LLC, doing business as Kevin Bailey Real Estate, an agent team with eXp Realty. Kevin Bailey is licensed in Virginia (#0225185511), the District of Columbia (#SP98370163) and Maryland (#5021908). Broker contacts and the office address are in the Disclosures below.

3. Age

The Services are for adults. You must be 18 or older to use them, to submit a form, or to hold a toolkit account. By using the Services you confirm you are 18 or older.

4. No agency relationship

Using the Services does not create a broker-client, agency or fiduciary relationship between you and Kevin Bailey Real Estate or eXp Realty. A real estate agency relationship requires a signed written agreement. Nothing on the Services is legal, tax, financial or investment advice, or an offer or solicitation to buy or sell real estate.

5. Property information, estimates and market data

The Services show homes Kevin has sold, homes Kevin is listing, and market figures. Sales figures come from Bright MLS and Kevin's own records; market figures for towns and counties come from Zillow Research and carry their date; timing patterns are history, not forecasts. All of it is believed reliable and none of it is guaranteed; verify anything you rely on. Listings may be subject to prior sale, price changes or withdrawal without notice, and square footage, lot size and other details are approximate.

Home value figures, net proceeds, readiness scores, timelines and offer comparisons produced by our tools or given on a call are estimates for planning. They are not appraisals, not a guarantee of any price, and not a substitute for a valuation by Kevin in person or an appraisal by a licensed appraiser.

6. Not legal, tax or financial advice

Content on the Services, including blog posts, market data, guides, tools and anything our AI assistant says, is general information only. Consult qualified, licensed professionals for advice about your situation.

7. Our AI assistant

Calls to our line may be answered, and follow-up calls placed, by an AI assistant acting for Kevin. It gives general information, schedules appointments on Kevin's calendar, and passes your request to Kevin; it does not give pricing, legal or commission advice or negotiate on Kevin's behalf. Calls the assistant handles are recorded, with a notice at the start, so Kevin can follow up personally; when a call is passed to Kevin, his part is not recorded.

8. The seller toolkit account

A toolkit account is for one person, 18 or older, about a home that person owns or is planning to sell. You sign in with a link emailed to you; keep that email account secure, since anyone who can open the link can open your toolkit. You may erase your account and everything saved in it from your profile page at any time. We may close an account that breaks these Terms or is used to abuse the Services. Numbers the toolkit shows are estimates (see section 5).

9. Your conduct

When using the Services you agree not to: scrape, crawl or harvest data with automated tools without written permission; try to gain access to any part of the Services, our systems or another person's account; misrepresent who you are or give false information; submit another person's details, including a referral, without that person's permission; upload or transmit anything unlawful, infringing or malicious; use the Services for any unlawful purpose; or interfere with the Services' operation, security or other people's use.

10. Communications and consent

When you give us your phone number on a form and click the button beneath the consent sentence, you consent to calls and texts from us about your request, including calls made or answered by our AI assistant. The toolkit asks separately, with an optional box. Consent is not a condition of any purchase or service. Message frequency varies; message and data rates may apply.

You can stop at any time: reply STOP to any text (which stops our calls to that number too), say "stop calling" on a call, withdraw consent in your toolkit profile, or contact us. Reply HELP to any text for help. Toolkit members receive a quarterly note on their area's market unless they turn it off; every such email has a one-click unsubscribe. 11. Intellectual property

The content of the Services, including text, photographs, graphics, logos, branding, blog posts, tools and design, is owned by Kevin Bailey Team LLC or used with permission, and is protected by copyright and trademark law. Photographs of homes Kevin sold are his. You may not reproduce, distribute, modify or republish content from the Services without prior written consent, except as the Services themselves allow (for example, sharing a guide through its share button).

12. Third-party links and services

The Services link to or use other companies' services, including Google Calendar for scheduling, YouTube for some blog videos, Cloudflare for spam checks, and the providers named in our Privacy Policy. Those services have their own terms and privacy policies, and we are not responsible for their content or practices.

13. Fair housing and equal opportunity

Kevin Bailey Real Estate is an Equal Housing Opportunity provider. We do business in accordance with the federal Fair Housing Act and the fair housing laws of Virginia, Maryland and the District of Columbia, and welcome all persons regardless of race, color, religion, national origin, sex, disability, familial status, age, marital status, sexual orientation, gender identity or expression, source of income or funds, military or veteran status, elderliness, or any other class protected by applicable law.

14. Disclaimers and limitation of liability

The Services and their content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, Kevin Bailey Team LLC, its agents and eXp Realty are not liable for any direct, indirect, incidental, consequential or punitive damages arising from your use of, or inability to use, the Services, including errors or omissions in content or in any estimate, even if advised of the possibility of such damages.

15. Indemnification

You agree to indemnify, defend and hold harmless Kevin Bailey Team LLC, eXp Realty, and their officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third party's rights.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Disputes arising under these Terms are resolved exclusively in the state or federal courts located in Loudoun County, Virginia.

17. Changes

We may update these Terms. Changes are posted on this page with a new "Last updated" date, and a material change is also announced to toolkit members by email.
